Summary:

Requires preconstruction disclosure from data centers to Utilities Commission, Department of Environmental Quality and local government, including projected electricity and water usage, cooling systems, and on-site clean power generation. Requires certificate from Commission to begin construction or operation of large data centers, with approval requiring: on-site clean generation capacity to offset at least 25% of projected peak electricity demand; water use standards, typically including closed-loop or reclaimed water cooling systems; cost-covering electricity, water and sewage rates. Provides for establishing rates and standards as mentioned. Prohibits financial incentives for data centers from utilities or government. Requires large data centers to report annually to Utilities Commission, Department of Environmental Quality, including electricity and water usage, cooling system efficiency, and on-site power generation. Reports to be made publicly available.
