Data Center Accountability and Citizen Protection Act (HB983, OH)

Excludes data centers from a privacy provision for businesses receiving financial incentives. Requires a citizen vote of any town within 5 miles before approval of a data center or data center expansion. Details including noise, light and power generation to be made public before votes. Directs director of environmental protection to establish air emission and wastewater discharge safety standards and limits for data centers and associated power generating facilities. Permits may not be granted to facilities not meeting the standards. Requires data centers to have and use wastewater treatment facilities and pollution removal technologies. Data centers with open-loop cooling must have: annual independent air quality and public health impact assessments, biologic testing for cooling tower emissions and use air cleaning and emissions control facilities. Permits for generators for new or expanded data centers may only be issued when closed-loop cooling systems are used, and all other standards are met. Requires wastewater discharge testing before new data centers start full operations. New data centers to use best available control technology and water consumption minimization methodologies. Data centers to disclose potential water pollutants and install meters to monitor chemical levels. Wastewater and air emissions to be tested at least weekly for chemicals and biologics. Data center to bear costs for all mitigations if it impacts water supply / pressure to neighbors within 5 miles. New data centers and expanded portions to generate 100% of their own energy and bear all their own power-related costs. New data centers to be built and operated off the public grid. Full disclosure of all agreements with data centers to be public and NDAs void. Prohibits regulator – data center rep revolving door absent 3-year breaks. Prohibits local tax incentives for data centers and associated generators.
