Summary:

Ends an existing tax break for data centers. Establishes certification process for data centers to demonstrate compliance with responsible infrastructure development (GRID) standards. These include: using increasing minimums of clean energy up to 32% in 2035 (or paying a hefty alternative compliance payment to Pennsylvania Economic Development Association); covering all electric utility costs; solar-ready facility; community outreach and consultation plan; community benefit plan with job and wage minimums; community benefit agreement addressing noise, air quality, traffic, financial contributions, etc.; regional benefits plan addressing similar impacts; sustainability plan including efficiency and emissions minimization, water withdrawal studies and restrictions; and noise and vibration mitigations. Qualified data centers to be eligible for sales and use tax break, must provide third-party verified confirmations of practices before operations and annually, along with electricity and water usage reports. Municipalities may report suspected violations. Application and report data is public unless department grants confidentially request.
