Summary:
Public Utility Commission to only approve data center contracts with electric utilities that mitigate costs falling on other customers, including minimum payments, collateral to mitigate stranded costs, and efficiency requirements. Contracts must also promote general good, not have adverse impacts on grid, result in economic benefit to State, and be consistent with environmental justice and equity policy. New data centers to ensure compliance with efficiency requirements during planning phase. Data centers to submit reports on energy and water use; Commissioner to report to legislature on data center impacts. States intent to use tax income from data centers to support energy, environmental, and economic benefits. Water usage, efficiency, discharge and pollution to be disclosed, mitigations applied, and permits obtained prior to approvals. Directs agency leaders to recommend a regulatory model for data center decommissioning.
