Summary:

Prohibits electric utilities from shifting costs due to data centers onto other ratepayers. Public Utilities Commission to review rates to ensure cost covering; utilities to file studies when increasing rates to support shared services. Utilities to recover costs for energy conservation programs from data centers. Data centers to bear impact of curtailments that they necessitate. Other measures to ensure cost covering of different varieties. Data centers required to contribute to funds that: supplement the Low-Income Home Energy Assistance Program and finance certain energy projects. Requires electricity supplied to data centers to include increasing proportions of in-state generated clean energy, up to 32% in 2035 (alternatively, they may increase contribution to energy projects fund). Electricity utilities to file contracts with data centers with commission for review and confirmation of no adverse impact on residential ratepayers. Commission to report to legislature annually on act implementation, impact of data centers on service and rates, and recommendations. Imposes emissions standards and usage limitations on fossil-fueled backup generators. Creates expedited interconnection for data centers that bring clean energy resources.
