Summary:
Prohibits large data centers on several land use categories, or in proximity to some of them or to bodies of water. Requires 500 ft setback with native plants and noise abatement measures. Requires public hearing before local authority can approve data center permit, rezoning request, etc. Establishes a Siting Board for large data centers, consisting of top State elected officials, which must confirm local data center project approvals after public hearing. Prohibits public utilities from collecting fees from other customers to cover data center construction-related costs. Prohibits providing incentives to data centers. Requires 5-year permit for high-volume non-agriculture water withdrawals; sufficient capacity must be demonstrated to grant or renew permit.
