Summary:
Does not allow confidentiality agreements regarding potential data centers to be extended beyond 1 year. Affirms that local government can regulate planning and land use regarding data centers. Requires data center electricity rate and fees that mitigates cost shifting to and risk being borne by other customers. Utilities may not contract with foreign-owned data centers. Water permits may not be granted to large data centers if their usage will be harmful to the water resources of the area; use of reclaimed water required whenever feasible. Directs Office of Program Policy Analysis and Government Accountability to commission an independent, interdisciplinary study of policy considerations related to data centers, including consideration of economic, land use, natural resources, energy, rates, and public health and safety impacts, and make recommendations on siting and impact mitigations.
