Summary:

Established a one-year moratorium on issuing approvals for large data centers that have not begun construction. Requires public hearing in host communities 3 months before any approvals may be granted; hearing requires 30-day notice with information about project; addressing efforts to mitigate impact on community and environment. Directs department of environmental conservation to report on environmental impact of data centers, including: current situation and projections for future; electricity usage; water usage and discharge; impact on water management; energy subsidies; land usage; impact on farmland; air, water and noise pollution; e-waste; public health impacts; public funds; impact on disadvantaged communities. report to recommend legislation to mitigate impacts. Requires electric and gas utilities and municipalities to create classification for data centers to ensure full cost-covering. Department of public service may require financial assurance. Similar requirements for water utilities. Energy Research and Development Authority to set mandatory energy consumption efficiency goals for data centers. Requires data centers to use increasing percentages of renewable energy, up to 90% in 2040. Additionally, they must demonstrate that they are using as much as is feasible from on-site renewable generation. Sets labor standards for large data center construction, and requires the use of US iron and steel.
